1. Acceptance of terms

By accessing or using WhatNightOut, whether through our website at whatnightout.uk or our mobile application (together, the “Service”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service.

2. The Service

WhatNightOut is a nightlife and music event discovery platform operated by whatnightout Ltd, a company registered in England and Wales. The Service aggregates event information from multiple public sources and third-party providers to help you discover events and venues across UK cities.

WhatNightOut is not a ticket seller, event organiser, or venue operator. We provide event information for discovery purposes only. Event details (including dates, times, prices, line-ups, and availability) are sourced from third parties and may change without notice. You should always verify event details directly with the venue or ticket provider before attending or purchasing tickets.

3. Eligibility

The Service is intended for users aged 18 and over. By using the Service, you confirm that you are at least 18 years old and are legally capable of entering into a binding agreement. Many of the events listed on the platform are age-restricted, and it is your responsibility to check any age requirements with the venue or event organiser before attending.

4. User accounts

You may browse events and venues on the Service without creating an account. An account is required to access certain features, including favouriting events, following venues, setting genre preferences, receiving personalised recommendations, and submitting events.

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials and not share them with others
• Accept responsibility for all activity that occurs under your account
• Notify us promptly if you suspect unauthorised access to your account

You may only create one account per person. We reserve the right to suspend or terminate accounts that violate these terms, are inactive for an extended period, or are being used in a way that is harmful to the Service or other users.

You may delete your account at any time through your profile settings. Upon deletion, all your personal data will be permanently removed in accordance with our Privacy Policy.

5. User content and submissions

You may submit events for inclusion on the platform. All submissions are subject to review and approval by our team. We reserve the right to reject, edit, or remove any submission at our discretion and without notice.

By submitting content (including event details, descriptions, and images), you:

• Confirm that you have the right to submit the content and that it does not infringe any third party’s intellectual property, privacy, or other rights
• Grant whatnightout Ltd a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute the submitted content on the Service and in related promotional materials
• Acknowledge that you retain ownership of your original content, but that the licence above survives even if you later delete your account or the submission is removed

You must not submit content that is:

• False, misleading, or fraudulent
• Defamatory, obscene, hateful, or discriminatory
• Infringing on any intellectual property rights
• Promoting illegal activities
• Spam, advertising, or unrelated to nightlife events

6. Acceptable use

When using the Service, you agree not to:

• Scrape, crawl, or use automated tools to extract data from the Service without our written permission
• Use bots, scripts, or automated means to interact with the Service
• Attempt to gain unauthorised access to our systems, servers, or other users’ accounts
• Interfere with or disrupt the operation of the Service or its infrastructure
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Circumvent, disable, or interfere with any security features of the Service
• Reproduce, redistribute, or commercially exploit any part of the Service without our written consent

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account and reporting illegal activity to the relevant authorities.

7. Event information disclaimer

Event information displayed on the Service (including event names, dates, times, venues, line-ups, prices, ticket availability, and descriptions) is aggregated from publicly available sources and third-party providers. While we make reasonable efforts to keep information accurate and up to date, we do not guarantee the accuracy, completeness, or reliability of any event information.

Events may be cancelled, rescheduled, or changed by organisers without notice to us. Prices shown may not include booking fees or other charges applied by ticket providers. It is your responsibility to verify all event details with the venue, organiser, or ticket provider before making plans or purchases.

WhatNightOut is not responsible for any loss, disappointment, or inconvenience arising from inaccurate or outdated event information.

8. Intellectual property

The WhatNightOut name, logo, visual design, and original content are the intellectual property of whatnightout Ltd. You may not use our branding, trademarks, or design elements without our prior written consent.

Event information is aggregated from public sources and third-party providers. Event images, logos, and promotional materials remain the property of their respective owners and are displayed for informational and promotional purposes in connection with the events they relate to.

You retain ownership of any original content you submit (see Section 5), subject to the licence you grant us upon submission.

9. Third-party links and services

The Service contains links to third-party websites, including ticket providers, venue websites, and event organisers’ pages. These links are provided for your convenience and do not imply endorsement.

When you follow a link to a third-party site (for example, to purchase tickets), you leave the Service and are subject to that site’s own terms and privacy policy. We have no control over, and accept no responsibility for, the content, policies, or practices of any third-party website. Any transactions you enter into with third-party providers are solely between you and that provider.

10. Limitation of liability

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, whatnightout Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, without limitation:

• Loss or disappointment arising from attending an event based on information found on the Service
• Losses arising from ticket purchases made through third-party providers linked from the Service
• Any disputes between you and an event organiser, venue, or ticket provider
• Loss of data, revenue, or profits
• Interruption or unavailability of the Service

Where liability cannot be excluded by law, our total aggregate liability to you for any claims arising from or relating to the Service shall not exceed £100.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

11. Indemnification

You agree to indemnify and hold harmless whatnightout Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to your violation of these terms, your use of the Service, or any content you submit through the Service.

12. Termination

You may stop using the Service at any time. If you have an account, you may delete it at any time through your profile settings.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these terms. Upon termination, your right to use the Service ceases immediately. Sections of these terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will continue to apply.

13. Changes to these terms

We may update these Terms of Use from time to time. The “Last updated” date at the top of this page indicates when the terms were last revised. For material changes, we will make reasonable efforts to notify you, for example via a notice on the website or mobile app. Your continued use of the Service after any changes constitutes your acceptance of the updated terms.

14. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed from these terms. The remaining provisions will continue in full force and effect.
